These Terms of Service ("Terms") govern your access to and use of GitHired, including our website, applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not access or use the Service. Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and protect your information.
To help explain things clearly, the following terms have the meanings set out below:
You must be at least 18 years old and able to form a legally binding contract to use the Service. By using GitHired, you represent and warrant that you meet these requirements and that your use of the Service does not violate any applicable law or regulation.
You may need to create an account to access some features of the Service. You agree to provide accurate, complete, and current information and to keep your account credentials secure.
You are responsible for all activities that occur under your account. If you believe your account has been accessed without authorization, you must notify us promptly.
GitHired provides tools for developer discovery, sourcing, profile analysis, candidate evaluation, and related recruiting workflows. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal business or personal use.

You retain ownership of any content you submit to the Service. By submitting content, you grant GitHired a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, and display that content solely as necessary to operate, maintain, improve, and provide the Service.
You represent and warrant that you have all rights, consents, and permissions necessary to submit your content and to allow us to use it as described in these Terms.
The Service may surface public or third-party sourced professional information, including developer profiles, work history, and activity signals. You are responsible for using that information in compliance with applicable law, platform terms, and your own hiring, privacy, and employment obligations.
GitHired does not guarantee the accuracy, completeness, or ongoing availability of third-party data. You should independently verify information before relying on it for recruiting, employment, or other decisions.
Certain features of the Service may require payment, a subscription, or the purchase of usage-based credits. By making a purchase, you authorize us and our payment processors to charge the applicable fees, taxes, and any other amounts due.
Unless otherwise stated, fees are non-refundable once paid. Subscription plans may renew automatically unless canceled before the next billing period. Credits, unlocks, or usage allowances may expire, reset, or be subject to plan-specific rules disclosed at the time of purchase.
We may add, modify, suspend, or discontinue all or part of the Service at any time. We do not guarantee that any feature, integration, workflow, or content will always be available, accurate, or error-free.
We may also impose limits on usage, storage, messaging, credits, or access to certain features in order to protect the Service, comply with legal requirements, or reflect plan entitlements.
The Service, including its software, design, branding, trademarks, text, graphics, and underlying technology, is owned by GitHired or its licensors and is protected by intellectual property and other applicable laws.
Except for the limited rights expressly granted in these Terms, no rights, title, or interest in or to the Service are transferred to you.
If you provide feedback, suggestions, or ideas regarding the Service, you agree that we may use them without restriction or compensation to you, and without any obligation of confidentiality, attribution, or payment.
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, created risk for other users, exposed us to legal liability, or misused the Service.
You may stop using the Service at any time. Provisions that by their nature should survive termination, including those relating to ownership, payments owed, disclaimers, limitations of liability, indemnity, and dispute resolution, will survive.
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, GitHired disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, error-free, or that any recruiting, hiring, sourcing, or business outcomes will result from its use.
To the fullest extent permitted by law, GitHired and its affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of, or inability to use, the Service.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid to GitHired in the 12 months before the event giving rise to the claim or (b) $100 USD.
You agree to defend, indemnify, and hold harmless GitHired and its affiliates, officers, employees, contractors, and agents from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your content, your use of the Service, or your violation of these Terms or applicable law.
These Terms are governed by the laws of the United States, without regard to conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved in courts of competent jurisdiction in the United States, unless applicable law requires otherwise.
We may update these Terms from time to time to reflect changes to the Service, legal requirements, or our business practices. When we do, we will post the updated Terms on this page and update the effective date above. Your continued use of the Service after the updated Terms become effective means you accept the revised Terms.
